Abstract
This study aims to determine the basis of judges' considerations in Decision Number 3281/Pdt.G/2017/PA.Sby. and to find out legal remedies which can be done in Decision Number 3281/Pdt.G/2017/PA.Sby. Research This study uses a normative juridical method, namely research using library research method or library research. Source of data obtained from literature and applicable legislation. Research results can be concluded that in Decision Number 3281/Pdt.G/2017/PA.Sby, the Assembly The judge rejected some of the counterclaims filed by the wife where one of the points in the counterclaim is about the distribution of assets together in the form of a Limited Liability Company. There are several considerations of the judge one who is deemed to have lacked a sense of certainty and justice is the judge does not consider the results of local inspections where one of the points states that there has been a sale of shares by the husband or the defendant of the Convention, besides that the judge also did not discuss any of the points of Reconvention lawsuit, namely regarding material confiscation of the Company's assets asset Limited (PT) which becomes collateral. From the above, there are efforts the law that can be done by the wife to get her rights, namely by carry out first-degree legal remedies (appeals) and third-level legal remedies second (cassation) Keywords : Joint Assets, Limited Liability Company, Legal Efforts, Judge's consideration.
