Abstract
Bankruptcy is the general confiscation of all assets of the Bankrupt Debtor which management and settlement are carried out by the Curator under the supervision of Supervisory Judge. With the issuance of a bankruptcy decision, the debtor loses the right to manage and control his property. The management and control is transferred to the Curator. However, the authority to manage and control his assets after the last bankruptcy did not occur just like the law. So, for that the Bankruptcy Law provide facilities to the debtor to regain authority to manage and control their assets back after the bankruptcy process completed by submitting an application for rehabilitation to the Commercial Court where bankruptcy is terminated. However, in practice there are few to no bankrupt debtors who take rehabilitation efforts as an integral part of the bankruptcy process. This study uses a normative legal research method which is a scientific research procedures to find truth based on logic legal science and its normative side. Sources of research data obtained from literature, applicable legislation, as well as interviews with Judges Surabaya Commercial Court and Curator of Surabaya Heritage Center. Results research found that there are circumstances that cause the rehabilitation efforts taken by the Debtor which include creditors tend to does not provide a certificate of payment satisfaction, the debtor is not cooperative, and debtors in the form of legal entities can be dissolved. And there are legal consequences that accompany if rehabilitation efforts are not taken., namely the legal consequences for the debtor and the legal consequences for the authority of the Curator over the Debtor.
