Abstract

The existence of virtual money that does not have a physical form, nor is it produced by a certain authority, nor is its value certain but is actually used as a means of payment that is worth wealth alongside conventional currencies makes it seem as if the role of the state has been reduced or at least the potential to be fundamentally reduced. Etherium is a decentralized digital currency and blockchain platform that has gained popularity in Indonesia. This thesis discusses the current legal framework for regulating Etherium transactions in Indonesia, including the provisions of the Regulation of the Minister of Trade of the Republic of Indonesia, Number 99 of 2018. The responsibilities of various parties involved in Etherium transactions, including buyers, sellers, and intermediaries. Crypto assets including etherium can only be traded as commodities and are prohibited from being used as a means of payment, however, because in practice crypto asset transactions continue to be widespread in the community, the potential for failure in crypto asset transactions in Indonesia will still result in liability for the parties, both due to acts of default and / or unlawful acts (onrechtmatige daad) and can even be an event of tort (wederrechtelijkheid). The research method used in this research is Normative and the data processing comes from literature study. This thesis discusses the potential legal consequences of fraud, breach of contract, and other violations in the context of Ethereum transactions.
