Abstract
ABSTRACT This study aims to determine the juridical position of Perppu no.2 year 2017 in terms of the Constitutional Court decision No.138/PUU-VII/2009 concerning the analysis of the Formation of Legislation made by the president regarding Amendments to Law Number 17 of 2013 concerning Community Organizations. In this study the authors used normative juridical research methods with data sources in this study obtained from library research consisting of primary legal materials, secondary legal materials, and tertiary legal materials.The data that has been collected is then analyzed using descriptive analysis method. The results of the study show that based on this background it can be concluded that the right to freedom of association and assembly is one of the derivations of civil and political rights, namely classic human rights. Recognition of the right to freedom of assembly and association is affirmed in Article 20 of the UN Charter, known as the Universal Declaration of Human Rights. Apart from that, the dissolution of Ormas in laws and regulations is contained in Law Number 8 of 1985, Law Number 18 of 2013, and most recently Perppu Number 2 of 2017. In Law Number 8 of 1985 Ormas can be dissolved unilaterally by the Government. As for Law Number 18 of 2013, an Ormas can only be disbanded if there is a Court Decision that has permanent force regarding the case. Keywords: Community Organizations, Constitutional Court Decisions, PERPPU ABSTRAKSI Penelitian ini bertujuan untuk mengetahui kedudukan yuridis perppu no.2 tahun 2017 ditinjau dari putusan MK No. 138/PUU-VII/2009 tentang analisa Pembentukan Peraturan Perundang-Undangan yang dibuat oleh presiden tentang Perubahan atas Undang-Undang Nomor 17 tahun 2013 tentang Organisasi Kemasyarakatan. Dalam penelitian in penulis menggunakan metode penelitian yuridis normative dengan sumber data dalam penelitian ini diperoleh dari studi kepustakaan tau library research yang terdiri dari bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Data yang telah terkumpul kemudian dianalisis menggunakan metode deskriptif analisis. Hasil penelitian menunjukan bahwa Berdasarkan latarbelakang tersebut dapat disimpulkan bahwa Hak kebebasan berserikat dan berkumpul merupakan salah satu derivasi dari hak-hak sipil dan politik, yakni hak-hak manusia yang klasik. Pengakuan terhadap hak kebebasan berkumpul dan berorganisasi terafirmasi dalam Pasal 20 Piagam PBB, yang dikenal dengan Universal Declaration of Human Rights. Selain itu Pembubaran Ormas dalam peraturan perundang-undangan terdapat dalam UU Nomor 8 Tahun 1985, UU Nomor 18 Tahun 2013, dan yang terbaru Perppu Nomor 2 Tahun 2017. Dalam UU Nomor 8 Tahun 1985 Ormas dapat dibubarkan secara sepihak oleh Pemerintah. Adapun dalam UU Nomor 18 Tahun 2013 Ormas hanya dapat dibubarkan, apabila sudah ada Putusan Pengadilan yang telah berkekuatan tetap tentang perkara tersebut.
