Abstract
The transfer of land rights can occur because it is transferred to inheritance. The rights of the heirs to the land certainly deserve to be questioned in the ownership of the land. The proof of ownership of the inherited land, which can then be transferred to the heirs, must of course be transferred to the authorized land office. The problems discussed in this study are regarding legal protection for the heirs as well as the implementation of the process of changing the name of the certificate on the inherited land. The research method used is empirical juridical, with a field study approach (observation). Methods of data collection is done by interview and observation. Data analysis is done by doing interpretations. The research location is at the Sidoarjo Land Office. The purpose of this study was to determine the form of legal protection for land heirs as well as to understand the procedures and processes for the transfer of title certificates to land by the heirs. The form of legal protection is contained in the Government Regulation of the Republic of Indonesia Number 24 of 1997, where the heirs can use or manage the inheritance land as well as have the right to register their ownership at the local land office. The transfer of the name of the certificate at the land office is carried out with the stages of registration, examination of files, payment of fees, processing, and issuance of certificates. Barriers to the implementation of the transfer of names at the land office came from internal and external sides. The government, especially the land office, must carry out socialization so that people can understand the ownership of inherited land.
