Abstract
The logical consequence of Indonesia as a state of law is that every act must be based on the law and always has consequences for every violation. Crimes in Indonesia are increasingly diverse in development, therefore the application of punishment must remain in accordance with the crime. One of the crimes that has developed in its sanctions is the crime of pedophilia. Pedophilia is a sexual activity involving young children, most of whose victims are under the age of 13. Violence, sexual harassment and exploitation, a form of violent crime, not only afflicts adult women, but also women who are classified as minors (girls). The type of research used by the author is normative research. Normative research is a type of legal research to determine suitability based on the logic of legal studies taken from a normative point of view. There is a disparity in the decision making by the East Java High Court in the imposition of Decision Number: 1271/Pid.Sus/2020/PT.SBY with Decision Number: 69/Pid.Sus/2019/Pn.Mjk on the grounds of creating substantive and procedural justice for the actions what the defendant did to the victim. The government needs to strengthen prevention efforts and provide heavier punishments for perpetrators of repeated sexual violence crimes, prepare technical implementing regulations for the implementation of additional punishments for chemical castration, infrastructure, human resources, both health workers and psychologists who accompany perpetrators who will undergo chemical castration procedures, and a budget to implement chemical castration in a sustainable manner.
