Abstract
The writing method used by the author is normative legal research which aims to examine and examine law as a norm or a principle to answer existing legal problems or issues through a statutory approach which is carried out by reviewing all legislation relating to criminal acts. carding crime. This study aims to determine the decision number 1106/Pid.B/2016/PN Jkt. UTR is related to the crime of carding in terms of the Information and Electronic Transactions Act. The results of the research obtained on the decision number 1106/Pid.B/2016/PN Jkt. Utr, namely the judge may consider the Electronic Information and Transaction Law related to the imposition of a criminal verdict on the defendant's actions because in his actions the defendant used electronic facilities in conducting electronic transactions. In addition, based on the evidence submitted, it can be related to the expansion of the evidence listed in Article 5 of the Law on Information and Electronic Transactions. Therefore, the imposition of the 4th Article 363 paragraph 1 on case number 1106/Pid.B/2016/PN Jkt. UTR is considered inappropriate because it does not meet the elements and the judge should have imposed Article 32 paragraph (2) of the Electronic Information and Transaction Law.
