Abstract

ABSTRACT : Children in conflict with the law fall into a special category (lex specialis) within the criminal justice system, as national law affords them protections distinct from those applicable to adult offenders. These protections are enshrined in the Juvenile Criminal Justice System regulations, which mandate an approach prioritizing the child's best interests. A concrete example of such protection is the implementation of diversion measures at every stage of the criminal proceedings. The number of cases involving children in conflict with the law handled by the Jombang District Attorney's Office (Kejari Jombang) regarding general criminal offenses is quite high, standing in stark contrast to the number of successful diversions achieved. This significant disparity stems from the previously outlined obstacles. Given that diversion is a right for children in conflict with the law—and that they must receive the rights guaranteed to them by statute—the Jombang District Attorney's Office is implementing solutions to ensure diversion is effectively applied in general criminal cases involving children. Key Word : Child, General Crime, diversion, district attorney's office
