Abstract
The current developments in online gambling methods involve the role of telemarketing, which actively promotes gambling sites through social media platforms. This study aims to analyze the elements of criminal acts and criminal liability for online gambling telemarketing under the Electronic Information Transaction of Law, as well as to examine the application of the law in Judgment No 19/Pid.Sus/2025/PN.Bdg. The research method applied is normative legal analysis, utilizing a statutory approach as well as case study analysis. The research results indicate that telemarketing activities meet the criteria of “distributing, transmitting, and or making accessible” Electronic Information related to gambling, in accordance with the provisions of Article 27 (2) in conjunction with Article 45 (3) of the EIT. Based on the analysis conducted of Judgment No. 19/Pid. Sus/2025/PN. Bdg, the judge imposed criminal liability on the defendant because it was proven that there was an element of intent in distributing links and invitations to gamble to the public.
