Abstract
Law Number 2 of 2004 concerning Industrial Relations Dispute Settlement (UU PPHI) requires every labor dispute to undergo bipartite and mediation stages as a formal requirement before being submitted to the Industrial Relations Court (PHI). However, the law does not explicitly regulate the settlement mechanism for joint lawsuits (samenvoeging van vordering) that encompass more than one type of dispute, as reflected in Decision Number 104/Pdt.Sus-PHI/2023/PN Sby, which combined disputes over rights and termination of employment (PHK). This legal ambiguity raises questions regarding whether the absence of regulations on the separation of dispute objects can hinder the protection of workers' rights, as well as how judges should interpret the law to address this legal vacuum. This study aims to analyze the forms of legal ambiguity in the UU PPHI and formulate appropriate legal interpretation patterns for PHI judges in deciding joint lawsuits. Utilizing a normative juridical method with statutory, conceptual, and case approaches, this descriptive-analytical research is supported by a literature review alongside theoretical frameworks on the protection of workers' rights and the joinder of claims. The results indicate that the Panel of Judges declared the lawsuit inadmissible (niet ontvankelijke verklaard) because they interpreted Article 86 of the UU PPHI as requiring all dispute objects to have fully satisfied the mediation process; thus, an incompleteness in one object invalidates the entire lawsuit. Consequently, the appropriate legal remedy for the workers is not an appeal to the Supreme Court (kasasi), but rather filing a new, separate lawsuit and re-undergoing mediation for the unfulfilled object.
