Abstract

This study aims to analyze the forms of legal protection for bank customers regarding the freezing of dormant accounts by banks and to analyze bank liability for losses suffered by customers. The study employs a normative-juridical legal research method utilizing both statutory and conceptual approaches, with a descriptive-analytical analysis based on primary, secondary, and tertiary legal materials. The findings indicate that freezing dormant accounts without prior notice, clear legal grounds, or indications of suspicious financial transactions violates the principles of prudence, trust, and banking confidentiality as stipulated in Law Number 10 of 1998 concerning Banking; furthermore, it is inconsistent with customer protection principles under Financial Services Authority Regulation Number 6/POJK.07/2022 concerning Consumer and Public Protection in the Financial Services Sector. Such actions can result in material and immaterial losses for customers; consequently, banks as financial service providers may be held liable for breach of contract or unlawful acts if the freezing is carried out unilaterally and contrary to established procedures.
