Abstract
Child sexual violence causes not only physical harm but also psychological trauma, social disruption, educational setbacks, and long-term consequences for victims. However, the criminal justice system often emphasizes punishing offenders rather than restoring victims' rights. This study examines the judges' legal reasoning in Decision No. 97/Pid.Sus/2025/PN Lmg from the perspective of Victim-Centered Justice and analyzes the forms of legal protection provided to the child victim. This normative legal research employs statutory and case approaches, with legal materials analyzed descriptively and qualitatively. The findings reveal that the judges partially applied the principles of Victim-Centered Justice by recognizing the victim's psychological trauma, unwanted pregnancy, and future harm as aggravating factors. Nevertheless, the decision failed to fully protect the victim's rights because it did not provide restitution or long-term recovery measures. Legally, child victims are entitled to forms of legal protection, including legal assistance, medical and psychological rehabilitation, restitution, identity protection, and continuous recovery under the Child Protection Law, the Juvenile Criminal Justice System Law, and the Sexual Violence Crime Law. However, these protections were not fully implemented in the decision. Therefore, stronger implementation of Victim-Centered Justice is required through restitution, comprehensive rehabilitation, and sustainable victim recovery.
