Abstract

This study analyzes the fulfillment of restitution rights for victims of sexual violence based on the judges' consideration in imposing substitute imprisonment for restitution in Decision Number 158/Pid.Sus/2024/PN Pgp, as well as the auction mechanism of seized assets belonging to the perpetrator if the restitution value remains unpaid. Using a normative legal research method, the results indicate that the subsidiary imprisonment handed down by the judges failed to prioritize the victim's special needs condition as a primary aggravating factor to achieve moral justice. The absence of a mandatory payment mechanism through asset seizure and auction renders the victim's right to restitution highly dependent on the defendant's economic willingness and capacity, thereby creating a loophole for the defendant to opt for substitute imprisonment. This condition reduces the coercive power of legal protection and reflects a regression toward a retributive approach, rather than restorative justice which prioritizes victim recovery as mandated by Law Number 12 of 2022 concerning the Law on Sexual Violence Crimes (UU TPKS).
