Abstract
ABSTRACT: The development of telemedicine has transformed the relationship between physicians and patients through the utilization of digital communication technologies in healthcare services. Despite its benefits, telemedicine raises legal issues concerning the boundary between medical risk and professional negligence that may give rise to criminal liability for physicians, particularly due to the absence of clear teleconsultation parameters within the Indonesian legal system. This study aims to analyze the construction of physicians’ criminal liability for medical teleconsultation malpractice within the legal systems of Indonesia, France, and Singapore, and to formulate an ideal regulatory framework for Indonesia. This research is a normative legal study employing statutory, conceptual, and comparative law approaches. The findings demonstrate that all three jurisdictions require fault, either in the form of intent or negligence, as the basis for physicians’ criminal liability. The principal difference lies in the existence of professional teleconsultation parameters used to assess such fault. France and Singapore have established more detailed teleconsultation standards, thereby facilitating the assessment and proof of physicians’ negligence. In contrast, Indonesia has yet to develop comprehensive professional teleconsultation parameters, resulting in the assessment of negligence remaining dependent upon the interpretation of general health law provisions. This study also finds that Article 308 of Law Number 17 of 2023 concerning Health potentially raises due process of law concerns because the recommendation of the disciplinary council functions as a prerequisite for the continuation of criminal investigations. Therefore, a specific teleconsultation regulation and a reformulation of the relationship between the disciplinary council and the criminal justice process are required. Keywords: Criminal Liability, Physician, Medical Malpractice, Medical Teleconsultation, Telemedicine.
