Abstract
Economic globalization has significantly increased insolvency cases involving assets, debtors, and creditors across multiple jurisdictions, giving rise to the phenomenon known as cross-border insolvency. Indonesian bankruptcy law, particularly Law Number 37 of 2004 on Bankruptcy and Suspension of Payment Obligations (KPKPU Law), grants curators authority to administer the entire bankruptcy estate. However, this authority proves largely ineffective when debtor assets are located abroad, as Indonesian Commercial Court rulings lack automatic extraterritorial force under the principle of territoriality. Using normative legal research with statutory and conceptual approaches, this study examines the inadequacy of the KPKPU Law in recovering overseas bankruptcy assets and evaluates the relevance of the UNCITRAL Model Law on Cross-Border Insolvency as a reform framework. The findings reveal that while the KPKPU Law normatively recognizes foreign-situated assets as part of the bankruptcy estate, it lacks operational mechanisms enabling curators to act beyond national borders. This gap includes the absence of provisions on recognizing foreign insolvency proceedings, curator access to foreign courts, inter-authority cooperation, and cross-border process coordination. The UNCITRAL Model Law addresses these shortcomings through five procedural mechanisms access, recognition, relief, cooperation, and coordination without disturbing the substantive principles of Indonesian bankruptcy law. Selective adoption of this instrument is therefore a pressing and relevant measure to strengthen curator authority and improve creditor protection in cross-border insolvency proceedings.
