Abstract
Village treasury land or tanah bengkok is a village asset that has strategic value in supporting the implementation of village governance and increasing village revenue. In practice, the use of village treasury land is often carried out through a lease agreement between the village government and the community. However, the implementation of village treasury land lease agreements does not always comply with the applicable legal provisions, thus potentially causing various legal problems.This research aims to determine the legal implementation of village treasury land or tanah bengkok lease agreements in Senden Village, Kediri Regency, as well as to identify the legal obstacles that arise in their implementation. The research method used is empirical juridical research with a statute approach. Data were obtained through direct interviews with the Senden Village Government and community members involved in the village treasury land lease agreements, and were supported by primary, secondary, and tertiary legal materials. The data obtained were analyzed descriptively and qualitatively to describe the implementation of village treasury land lease agreements based on the applicable legal provisions.The results of the study show that the implementation of village treasury land or tanah bengkok lease agreements in Senden Village has basically been carried out based on agreements between the village government and tenants, with the aim of land utilization and increasing village revenue. However, in practice there are still several problems, such as the suboptimal administration of agreements, lack of adequate written documentation, and low public understanding of the legal provisions regarding the management of village assets. The legal obstacles encountered include aspects of administration, supervision, and legal certainty regarding the rights and obligations of the parties. Efforts that can be made to overcome these obstacles are to improve the orderly administration of agreements, strengthen supervision by the village government, and ensure that every use of village treasury land is carried out in accordance with the provisions of the applicable laws and regulations.
