Abstract
The return of evidence of a criminal act of embezzlement after an inkracht decision is an important part of the implementation of a criminal decision because it involves restoring the rights of the entitled party. This research aims to examine the implementation of returning evidence at the Kediri City District Prosecutor's Office, along with the obstacles and efforts. The innovation in this research lies in the focus of the study which focuses more on the post-trial stage which rarely receives attention. The method used is empirical juridical with a statutory and conceptual approach. Data was obtained through literature study, observation, interviews, and a review of the administration of P-48 embezzlement cases for the period June 2021 to June 2025. The research results show that the return of evidence was guided by the Criminal Procedure Code, Prosecutor's Regulations, and Asset Recovery Guidelines, including through the ABANGSIS service. However, the issuance of P-48s does not always meet the seven working day deadline due to administrative constraints, coordination, storage facilities, passive attitude of the entitled parties, and completeness of ownership documents. Efforts made include strengthening coordination, digitizing data collection, ball pick-up services, as well as flexibility in proving ownership. These findings emphasize the need for supervision of executions so that legal certainty and restoration of victims' rights can be carried out more effectively.
