Abstract

Marriage dispensation is a marriage permit granted by the Religious Court to prospective spouses who have not reached the legal marriage age pursuant to Law Number 16 of 2019 concerning Marriage. This study aims to determine the implementation of marriage dispensation applications during the Covid-19 pandemic at the Sidoarjo Religious Court, as well as the obstacles faced and the efforts made to resolve them. The method used in this study is empirical juridical with a qualitative descriptive approach through interviews, observation, and documentation. The results show that the implementation of marriage dispensation applications during the Covid-19 pandemic was not significantly different from before the pandemic; however, during the pandemic, the use of the E-Court system in court proceedings became more intensive, and the number of attending parties during hearings was restricted. Obstacles such as the applicants' lack of education regarding the submission of dispensation application documents and limited hearing schedules during the pandemic inevitably occurred. Consequently, the Sidoarjo Religious Court made efforts to continuously educate applicants regarding court procedures while maintaining the health of both applicants and court personnel.
