Abstract

This study examines the juridical implications of the absence of a condemnatory order (condemnatoir) in civil court judgments, with a particular focus on Decision Number 31/Pdt.G/2020/PN Jbg. This research employs a normative legal method using statutory and case approaches, supported by relevant legal materials. The findings indicate that a judgment that does not contain a condemnatory order (condemnatoir) fundamentally lacks executorial force because it merely determines or affirms a legal status without containing an order that can be enforced through the execution mechanism as regulated under civil procedural law. As a consequence, the fulfillment of the parties' rights cannot be realized through the execution process. Therefore, the inclusion of a condemnatory order in a civil judgment plays an essential role, as it serves as the legal basis for the execution of the judgment and ensures legal certainty as well as the fulfillment of the parties' rights.
