Abstract

Corruption has caused widespread suffering through state finansial losses, resulting ini hindered national development and reduced public welfare. The additional penalty of restitution of payment remains far from capable of optimally recovering state finansial losses. This condition indicates the existence of optimally recovering state finansial losses. This condicition indicates the existance of problems in both the regulation and implementation of restitution payment when examined from the perspective of the principle of legal utility. This study aims to analyze the principle of legal utility ini the regulation and implementation of the additional penalty of restitution payment for perpetrators of corruption, as well as to formulate a more affective regulatory concept ini supporting the recovery of state losses. The research method employed is normative legal research using conceptual, statutory, and comparative approaches. The principle of utility in restitution payment is assessed through utilitarian theory, partoicularly the Hedonistic Calculus, which demontrates that the implementation of restitution payment generates more suffering than happines. Limitations on the amount of restitution payment and the existence of subsidiary imprisonment as a subtiute penalty have prevented the optimal recovery of state losses. Therefore, a recontruction of the regulation of restitution payment is necessary in order to provide greater utility in terms of recovery and prevention, in line with the objectives of punishment under the National Criminal Code. The restitution payment mechanisme may be reconstructed though strengthening aset tracing, seizure, and confiscation mechanisms in order to achieve the recovery of the state finansial losses that provides the greatest benefit to society.
