Abstract

Abstract Marriage is a sacred relationship, because it must focus on the rules that exist in society. Thus, marital relations that are not registered in the state will have a bad impact on family harmony. Meanwhile for children, the invalidity of marriages that are not registered (under the hands) according to state law has an influence on the situation of children born in the eyes of the law, namely the position of children who are born suspected of being illegitimate children. The purpose of this study is to understand the form of legal protection for the rights of children as a result of unregistered marriages. This study aims to research normative law (normative law research) using a normative case study approach in the form of a product of legal behavior, for example researching the law. The results of the study indicate that in Indonesia there are many incidents of children from unregistered marriages who do not get a living from their fathers because legally in Indonesia, unregistered marriages are not recognized. However, the mother of the child resulting from an unregistered marriage can take legal action so that the child gets the right to earn a living from his father.
