Abstract

This research examines the legal position of genetic information (DNA profiling) as evidence for identifying victims of mutilation murder under Indonesian criminal law. Using a normative legal method with statutory, conceptual, and case approaches, the study finds that regulations governing genetic information remain fragmented, creating procedural gaps in its use as evidence and in protecting post-mortem genetic privacy. Under the former Criminal Procedure Code (KUHAP), genetic information functioned only as supporting evidence, whereas the new Criminal Procedure Code (Law Number 20 of 2025) allows it to serve as independent evidence under the open system of proof, provided it is obtained lawfully. The study recommends harmonizing cross-sectoral regulations to ensure legal certainty and strengthen justice for victims of mutilation murder.
