Abstract

The development of digital technology and social media has opened up wider space for people to express themselves. However, on the other hand, this development has also given rise to various problems, one of which is in the case of criminal defamation through social media. This phenomenon is reflected in Putusan No. 67 / Pid.Sus / 2025 / PN.Kpn regarding the case of Adrena Isa Zega (Defendant) who was sentenced to 3 (three) years and 6 (six) months in prison and a fine of Rp10,000,000 (ten million rupiah) for alleged defamation through content on social media. Although the identity of the victim was not clearly stated in the content in question, the Defendant must still undergo criminal sanctions. This study aims to examine two main issues, namely the position and regulation of electronic evidence in Indonesian criminal procedure law in criminal defamation and the Judge's assessment in assessing the validity and strength of electronic evidence in PutusanNo. 67 / Pid.Sus / 2025 / PN.Kpn. Using normative legal research methods with descriptive-prescriptive nature through the statute approach, conceptual approach, and case approach. The results of this study confirm that firstly, electronic evidence has obtained a position as valid evidence based on Pasal 5 UU No. 11/2008 about ITE as amended by UU No.1/2024. Then secondly, the Judge must verify the validity of electronic evidence which is strengthened in Pasal 242 KUHAP 2023.
