Abstract

This study aims to analyze the fulfillment of the elements of tort committed by contract manufacturing companies through the use of hazardous substances in cosmetic production and the resulting civil liability. This research employed a normative legal method using statutory and conceptual approaches, analyzed prescriptively based on tort theory and the theory of legal liability. The findings indicate that the use of hazardous substances fulfills all elements of tort under Article 1365 of the Indonesian Civil Code, namely the existence of an act, unlawfulness, fault, damage, and a causal relationship. Such conduct also violates Law Number 17 of 2023 on Health, Government Regulation Number 28 of 2024, and regulations of the Indonesian Food and Drug Authority concerning cosmetic safety and quality. Accordingly, contract manufacturing companies are civilly liable to provide compensation for material and immaterial damages, as well as restoration to the injured party. Furthermore, limitation of liability clauses in manufacturing agreements cannot eliminate civil liability where losses arise from the manufacturer's fault or unlawful conduct.
