Abstract

This study aims to analyze the legal consequences of the application of actio pauliana to trademark purchasers and the legal protection available to third parties following an actio pauliana decision. This research employs a normative legal research method using statutory, conceptual, and case approaches. The findings indicate that the application of actio pauliana in Decision Number 67/Pdt.Sus-GLL/2023/PN Niaga Sby resulted in the annulment of the trademark transfer and its return to the bankruptcy estate. Legal protection for trademark purchasers as third parties is provided under Article 49 of the Bankruptcy Law in the form of compensation rights or recognition as concurrent creditors. However, such protection remains limited because it depends on the sufficiency of the bankruptcy estate and does not guarantee full recovery of losses.
