Abstract

Digitalization has driven the rise of kid influencers in digital commercial obligations. This normative juridical research, employing statutory, conceptual, and case approaches, analyzes the validity of endorsement contracts involving minors and their dispute resolution. The results indicate that independent involvement of minors triggers subjective validity issues under Articles 1320 and 1330 of the Indonesian Civil Code. The juridical implication of electronic contracts signed by minors without formal parental consent is voidable, rather than void ab initio. The contract remains legally binding until officially annulled by a judge. In the event of a breach of contract, dispute resolution can be pursued through litigation (civil lawsuit in the District Court) or non-litigation mechanisms (negotiation, mediation, conciliation, and arbitration). Active parental involvement serves as a crucial preventive instrument to eliminate economic exploitation, ensure legal certainty, and protect the child's essential rights.
