Abstract

This research analyzes the legal regulation of underage marriage dispensation and the implementation of child protection principles in judicial decisions, particularly Decision Number 33/Pdt.P/2024/PA.Po. The issue examined arises from the inconsistency between the legal provisions governing the minimum age for marriage and the continued practice of courts granting marriage dispensations. This study applies a normative juridical method through statutory and conceptual approaches. The findings indicate that the regulation on the minimum marriage age is fundamentally intended to prevent child marriage; however, judges still possess considerable discretion in deciding dispensation cases, which leads to varying legal considerations in court decisions. In the examined ruling, the judges gave greater weight to urgent circumstances rather than prioritizing long-term protection for the child. Consequently, the principle of the best interests of the child has not been fully realized in its application. Therefore, this study concludes that a more consistent and stricter implementation of the law is necessary to ensure maximum protection for children.
