Abstract

Trade globalization makes trademarks an important global identity, where the Indonesian legal system applies the first-to-file principle which can trigger disputes, such as in the M6 trademark case between BMW and BYD. This study aims to analyze the validity of the lack of parties (Plurium Litis Consortium) ruling in Decision Number 19/Pdt.Sus-HKI/Merek/2025/PN Niaga Jkt.Pst and the legal remedies that BMW can take. This research uses a normative juridical method with a descriptive-analytical nature, and applies statutory, case, and conceptual approaches. The results show that the judges’ consideration declaring the lawsuit lacking parties (plurium litis consortium) is considered potentially too formalistic, because the distributor actually uses and circulates the branded products in Indonesia so they can be held civilly liable. The use of the "M6" mark by PT BYD Motor Indonesia should be considered as containing bad faith because BMW AG registered it first. Litigation legal remedies that BMW can take include an appeal, judicial review, or filing a new lawsuit. Keywords: BMW, BYD, Dispute, First to File Principle, Trademark.
