Abstract

The Suspension of Debt Payment Obligations (PKPU) is a legal mechanism aimed at providing debtors with the opportunity to restructure their debts through a reconciliation plan. In practice, concurrent creditors are often in a weak position due to their lack of material collateral, potentially exposing them to injustice and loss during the decision-making process, including the distribution of bankruptcy assets. This study aims to analyze the normative construction of the status and legal protection of concurrent creditors in the PKPU regime according to the Bankruptcy & PKPU Law and to examine the implementation and consistency of this protection in Homologation Decision No. 346/2022. The research method used is normative juridical, with a statutory, conceptual, and case-based approach. The results show that, normatively, concurrent creditors have the same rights as secured and preferred creditors. In practice, the decisions reviewed indicate that protection for concurrent creditors is not yet fully optimal and often results in losses and injustice due to the dominance of certain creditors who influence the reconciliation proposal and the reconciliation decision.
