Abstract
Court-ordered gender reassignment rulings give rise to legal issues, particularly regarding the interpretation of the phrase "a man and a woman" in Article 1 of the Marriage Law and the legal consequences for marriages entered into following such a ruling. This study aims to analyze the judge's reasoning in granting the gender change petition in Ruling Number 9/Pdt.P/2021/PN Wat, to analyze the interpretation of the phrase "a man and a woman" from both biological and juridical perspectives, and to examine the legal implications for marriages contracted after the ruling. The study employs a normative juridical method utilizing statutory, conceptual, and case-based approaches. Legal materials comprising primary, secondary, and tertiary sources were gathered through literature review. The findings indicate that the judge's reasoning in granting the petition did not comprehensively consider the various provisions of positive law applicable in Indonesia. Furthermore, the phrase "a man and a woman" is more appropriately interpreted based on biological sex as substantiated by civil registry documents to ensure consistency and legal certainty. Additionally, a gender reassignment ruling carries legal consequences solely within the realm of civil registration and does not automatically determine the validity of a marriage. Consequently, any marriage entered into after such a ruling must still be assessed against applicable legal provisions, as it may give rise to legal issues concerning its validity.
