Abstract
The phenomenon of interfaith marriages conducted abroad by Indonesian citizens has grown as a means of circumventing national marriage law restrictions. This research aims to analyze the legal validity of interfaith marriages of Indonesian citizens conducted abroad before and after the enactment of Supreme Court Circular Letter Number 2 of 2023 (SEMA No. 2/2023) and the legal implications arising on the legal status of the parties involved. The method used is normative juridical with statutory and conceptual approaches through library and document analysis. The findings reveal that prior to SEMA No. 2/2023, the absence of binding judicial guidelines resulted in inconsistent legal application in interfaith marriage registration. Following its enactment, all judicial registration pathways were entirely closed. Although such marriages may be valid under the lex loci celebrationis principle, they are not recognized under Indonesian law for failing to satisfy Article 2(1) of the Marriage Law, leaving the parties with an unregistered marital status. This condition generates systemic legal implications for both spouses, including limited protection over maintenance rights, inapplicability of the joint property regime, and unavailability of formal divorce proceedings, with wives placed in a structurally more vulnerable position. For children, the implications are more severe as they retain only a civil relationship with the mother, face inheritance barriers from the father, and risk incomplete civil registration documents. Although Constitutional Court Decision No. 46/PUU-VIII/2010 opened avenues for recognizing civil relations through scientific evidence, this mechanism does not equate to legitimate child status.
