Abstract
Advances in Artificial Intelligence (AI) have given rise to a new technology for creating highly realistic visual and audio content: deepfakes. One example is pornographic content particularly child pornography, or what is known as Artificial Intelligence-Generated Child Sexual Abuse Material (AI-CSAM) which is child sexual abuse material manipulated using AI, such as deepfakes, by superimposing a child’s face onto pornographic content or creating entirely synthetic material. This situation raises legal issues regarding the fulfillment of the elements of a criminal offense and the criminal liability of perpetrators within Indonesia’s legal system under the ITE Law, the Pornography Law, and the Child Protection Law. The study employs a normative legal methodology and approaches including legislative analysis, conceptual analysis, and case studies. The results of this study confirm that the elements of the AI-CSAM criminal offense, through the systematic application of the lex specialis systematis, satisfy the elements of Article 6 paragraph (1) of the Pornography Law, with the criminal provisions of Article 29 to prosecute perpetrators who produce or create CSAM content using AI, such as deepfakes. The concept of criminal liability known as “Perception by another liability” further clarifies that users who instruct AI to create CSAM content must be held responsible, as AI is merely a tool that follows the user’s commands.
