Abstract

The dialectic between the values of justice and legal certainty in Indonesia's first-to-file system is analyzed through a case study of the MS Glow vs. PS Glow trademark dispute. Using normative legal research methods, this study investigates the forms of legal protection for disputing parties and efforts to harmonize the underlying legal principles. Combining a statutory approach, a conceptual approach, and a case approach through an in-depth analysis of Commercial Court and Supreme Court rulings. The findings indicate that the implementation of the first-to-file doctrine should not be viewed as a rigid administrative procedure. Legal authorities need to integrate parameters of good faith, the factual use of the trademark in the market, and substantive justice into the decision-making process. This is crucial to ensure that legal protection is not merely a registration formality but is capable of guaranteeing proportional justice for legitimate trademark holders and preventing unfair business competition practices.
