Abstract

Personal data protection constitutes a part of human rights that must be guaranteed by the state, including the protection of customers' financial data in the banking sector. The use of customer data, such as bank account transaction records, as evidence in open court proceedings raises legal issues because, on the one hand, such data serves as legally admissible evidence, while on the other hand, it remains personal data that must be protected under Law Number 27 of 2022 concerning Personal Data Protection. This study aims to analyze the legal status of customers' personal data used as evidence in open court proceedings and the forms of legal protection provided to customers regarding the use of such data. This research employs a normative legal research method using statutory and conceptual approaches, supported by primary and secondary legal materials analyzed qualitatively through library research. The results indicate that customers' personal data possesses a dualistic legal status, namely as personal data that must be protected and as legally valid evidence in judicial proceedings. Its utilization must continue to adhere to personal data protection principles, including the principles of prudence, purpose limitation, and data minimization. The unrestricted disclosure of personal data in open court without proportional limitations has the potential to violate customers' privacy rights and may result in legal liability in the form of compensation.
