Abstract

Claims for non-material damages (immateriil) in breach of contract cases (default) consistently spark juridical debate, both regarding their legal basis and the consistency of judicial reasoning in granting or dismissing such claims. The disparity in legal reasoning within judicial practice necessitates an in-depth study, particularly concerning the judge's obligation as an active and independent law enforcer. This research aims to analyze the judicial considerations regarding non-material damages in Decision Number 707/Pdt.G/2024/PN Jkt.Utr and to evaluate the alignment of the judge's legal reasoning with the principle of ius curia novit. This study is a normative legal research employing an integrative methodology consisting of the statute approach, case approach, and conceptual approach, all of which are analyzed qualitatively to measure compliance with prevailing legal principles. The findings indicate that the judge's considerations in the aforementioned decision were restrictive and formalistic. The dismissal of the claim ignored the clear causal link between the debtor's default and the actual losses suffered by the Plaintiff. Furthermore, the decision does not yet reflect the application of the ius curia novit principle, which requires judges to actively explore, follow, and understand the legal values and sense of justice existing within society. The study concludes that there is a need to strengthen the construction of judicial legal considerations so that they are not merely oriented toward legal certainty, but also proportionately accommodate aspects of justice and utility. This is essential to realize a substantive and equitable civil justice system. KEYWORDS: : ius curia novit, non-material damages, legal reasoning, judicial considerations, breach of contract.
