Abstract

The complex development of the business world has given rise to debt issues that require effective legal resolution. Suspension of Debt Payment Obligations (PKPU) is an alternative legal mechanism before bankruptcy under Law Number 37 of 2004. This study analyzes the application of PKPU requests by individual creditors in Decision No. 10/Pdt.Sus-PKPU/2025/PN Niaga Surabaya using normative legal research methods with statutory, case, and conceptual approaches. The results indicate that the PKPU request filed by Darmin, an individual creditor, against PT. Nusantara Indah does not comply with applicable legal requirements. PT. Nusantara Indah has been liquidated since 2023, thus no longer having active legal status, and management authority has been transferred to the liquidator. The request contained a formal flaw, error in persona, and was rejected by the Panel of Judges. Consequently, creditors lost access to debt restructuring mechanisms. However, creditors can still file a civil lawsuit against the liquidator or seek non-litigation resolution through mediation as a more efficient alternative.
