Abstract

Human trafficking (TPPO) is a crime that violates human rights and is classified as an extraordinary crime. Developments indicate that human trafficking is not only committed by adults but also involves children as perpetrators, including in the role of pimps. This raises complex legal issues, particularly regarding the criminal liability of children and the harmonization of the application of norms between Law Number 21 of 2007, Law Number 11 of 2012, and Law Number 35 of 2014. This study aims to analyze the criminal liability of children in human trafficking crimes and the judge's considerations in issuing a verdict in case Number 55/Pid.Sus-Anak/2024/PN.Sby. This research is a normative legal study using statutory, conceptual, analytical, and case-based approaches. The legal materials used include primary, secondary, and tertiary legal materials, analyzed descriptively and qualitatively. The research results indicate that criminal accountability for child traffickers must prioritize the principle of the child's best interests, as stipulated in the juvenile criminal justice system. In the decisions analyzed, judges imposed prison sentences and job training on child traffickers, taking into account legal, sociological, and psychological aspects. However, there was a lack of harmony in the application of norms between provisions on the eradication of trafficking and specific provisions regarding the criminalization of children, particularly in the use of inappropriate legal bases. Therefore, harmonization and systematic interpretation are needed to ensure that law enforcement against child traffickers continues to guarantee justice, legal certainty, and the protection of children's rights.
