Abstract
In the contemporary era, seamless access to information has facilitated the emergence of novel criminal offenses, notably online gambling, as governed by Law Number 1 of 2024 on Electronic Information and Transactions. The judge, as the vanguard of criminal justice, rendered a verdict of acquittal in an online gambling case under Decision Number 97/Pid.Sus/2025/PN Sda. This ruling has consequently destabilized legal certainty and diminished both the deterrent effect and societal protection. This study examines the conceptual framework of gambling and the alignment of the judicial decision with prevailing legislation. Employing a normative-juridical method, the research integrates statutory, conceptual, and case approaches. The findings reveal that the judicial reasoning provided was inadequate, which ultimately undermines the fundamental objectives of criminal law. Pursuing substantive justice within the community by factoring in its sociological conditions is proposed as the resolution to this problem.
