Abstract
Corruption is considered an extraordinary crime that causes significant losses to state finances and has broad impacts on social, economic, and governmental aspects. Therefore, in addition to prosecuting the perpetrators, efforts to recover assets resulting from corruption are essential in order to restore state financial losses. This study aims to analyze the implementation of asset recovery in corruption cases and to identify the obstacles and efforts faced by the Tanjung Perak District Attorney’s Office in the asset recovery process. This research uses an empirical legal research method with a case approach and a statutory approach. The research data were obtained through observation, interviews with prosecutors at the Tanjung Perak District Attorney’s Office, and literature studies of relevant laws and legal literature. The results of the study show that the implementation of asset recovery in corruption cases at the Tanjung Perak District Attorney’s Office is carried out through several stages, including asset tracing, seizure, confiscation, and the return of assets to the state. However, in practice, several obstacles are still encountered, such as limited evidence, assets transferred to third parties, and the complexity of asset tracing processes. To overcome these obstacles, the Prosecutor’s Office coordinates with related institutions and strengthens asset tracing and management efforts in order to optimize the recovery of state losses caused by corruption.
