Abstract

This normative legal research analyzes the proof of the actus reus and mens rea elements in the criminal act of attempted intermediary of Class I Narcotics transactions, with a case study on Decision Number: 572/Pid.Sus/2014/PN.Jkt.Utr and Decision Number: 163/Pid.Sus/2015/PN.Mam. The main problem is to examine the judge's legal considerations in proving the fulfillment of the actus reus (physical act) and mens rea (malicious intent) elements at the intermediary trial stage, as well as the relevance of the theory of the attempt in this context. The research uses a case study approach and comparison of decisions, analyzing primary legal materials (Narcotics Law, Criminal Code, Decisions) and secondary (criminal law literature) descriptively-analytical. The results of the study indicate that the proof of actus reus focuses on the initial actions of the actual implementation, such as communication and preparation of the transaction, which are considered to have shown the perpetrator's mens rea. Despite the differences in the application of the attempted theory, this study concludes that the consistency of proof of actus reus and mens rea is crucial to distinguish between intentions that have not yet been realized and the beginning of implementation that can be criminally accounted for, especially in the context of narcotics crimes.
