Abstract

The phenomenon of samenvoeging van vordering (joinder of claims) is a common occurrence in civil litigation practice in Indonesia, fundamentally reflecting the pursuit of justice by parties who have suffered harm as a result of the actions of others. Notwithstanding its prevalence, a considerable number of samenvoeging van vordering applications have ultimately resulted in a declaration of Niet Ontvankelijk Verklaard (NO) by adjudicating panels on various grounds, thereby giving rise to a fundamental question concerning the legal framework governing samenvoeging van vordering under Indonesian positive law, a subject that to this day has not been comprehensively regulated, despite the fact that its practice has long been recognized in the forms of both subjective and objective claim accumulation. One case that aptly illustrates this problem is Case Number 1306/Pdt.G/2024/PN Sby, in which the samenvoeging van vordering submitted by the parties was declared inadmissible by the adjudicating panel on the grounds that the element of connexity (koneksitas) among the parties had not been fulfilled. Departing from this legal issue, the present research aims to examine whether the element of connexity was in fact satisfied in the aforementioned case, assessed through the lens of the principle of legal separate entity and other relevant legal doctrines, whilst simultaneously evaluating the available legal remedies and alternative dispute resolution mechanisms that may be pursued by the litigating parties. This research employs a normative juridical methodology with a descriptive analytical research character, supported by multiple analytical approaches in order to comprehensively examine the case at hand.
