Abstract

The Indonesian government has refined its conservation law, Law No. 32 of 2024, which establishes a minimum criminal penalty for violators of wildlife laws. This study applies a normative juridical method, supported by a legislative approach, a case study approach, and a conceptual approach. The findings of the analysis indicate that in practice, the minimum criminal penalties stipulated in Law No. 32 of 2024, particularly Article 40A paragraph 1, have not been fully implemented. A decision in a case of the crime of deviating from and transporting pangolin scales, Decision Number 10-K/PM.I-02/AD/II/2025, in which the panel of judges decided to impose a prison sentence of one year each on the defendants, instead of the minimum sentence of three years. The absence of statutory regulations or other legal basis that regulates deviations from the minimum criminal provisions has resulted in this decision being deemed not to reflect legal certainty and has the potential to lead to inconsistencies in the application of the law by judges in similar cases in the future, which could lead to disparities in sentencing and weaken the function of norms as binding guidelines in the criminal justice system.
