Abstract

The sports industry, including the field of basketball, has experienced significant growth along with the increasing number of successful athletes. Various sports clubs, particularly basketball clubs, have begun to focus on children and adolescents as part of their long-term development strategies. The main issue arises when professional basketball clubs attempt to recruit underage athletes. Under Indonesian civil law, minors do not possess full legal capacity to enter into agreements. This study aims to analyze the legal requirements of a valid agreement as stipulated in Article 1320 of the Indonesian Civil Code (Kitab Undang-Undang Hukum Perdata) and to examine the juridical implications of employment contracts involving underage athletes and sports clubs. The results of this study indicate that employment contracts involving underage athletes have the potential to be considered legally defective due to non-compliance with the requirements set forth in Article 1320 of the Indonesian Civil Code. However, if parents or legal guardians act as lawful representatives, such contracts may still be recognized as legally binding. Keywords: Contract, Underage, Basketball.
