Abstract

This study examines the implementation of Article 284 of the Indonesian Criminal Code (KUHP) against members of the Indonesian National Armed Forces (TNI) involved in adultery cases at the Military Prosecutor’s Office (Oditurat Militer) IIIII Surabaya. The aim is to determine the enforcement process and the obstacles that arise during its implementation. The method used is empirical legal research with a qualitative approach through interviews with military law enforcement officers and a review of case documents. The findings show that the implementation of Article 284 KUHP is carried out based on the KUHP as substantive law and Law Number 31 of 1997 on Military Courts as procedural law. The case settlement process is conducted through investigation by the Military Police, prosecution by the Military Prosecutor, and trial at the Military Court. However, the enforcement process faces several obstacles, such as difficulties in proving the offense, limited evidence, and the influence of superiors who often prefer administrative resolution rather than criminal prosecution.
