Abstract

This research examines was carried out to analyze and examine the judge's consideration in deciding child custody in divorce cases at the Singaraja District Court through Decision Number 441/Pdt.G/2018/PN.Sgr and Decision Number 186/Pdt.G/2017/PN.Sgr. The issue of child custody as one of the legal result of divorce requires judges to consider the best interest of the child, parental abilities, and socio-cultural conditions, including the influence of the patrilineal system (purusa) in Balinese customs which are often different from national laws. This study uses normative legal methods with statue approach, case approach, and conceptual approach, based on the Civil Code, the Marriage Law, the Child Protection Law, and related decisions. The results of the study show that in Decision 441/Pdt.G/2018/PN.Sgr, the judge gave custody to the father, while in Decision 186/Pdt.G/2017/PN.Sgr it was given to the mother. This confirms that the principle of the best interest of the child is the main basis, while customary law is considered as long as it does not neglect the interests of the child.
