Abstract

Collateral is essential in financing and debt agreements because it provides creditors with assurance and serves as a safety net if the debtor fails to repay. However, the legal position of a guarantor remains debated, as the terms of the agreement may place the guarantor in a role nearly equal to the debtor, potentially causing disadvantage. If the debtor defaults, the creditor may seek payment from the guarantor. This study aims to examine the legal status and responsibilities of third-party guarantees (borgtocht) in protecting creditors. Using a normative juridical method, the research shows that borgtocht is a form of guarantee in which a third party becomes responsible for the debtor’s obligations when the debtor fails to fulfill them.
