Abstract

This study uses a normative legal approach with a case study method to examine PMH in the distribution of inheritance in the form of shares, as reflected in Case Decision Number 708/PDT/2024/PT SBY. By examining legal documents, laws and regulations, and court decisions, this study analyzes the deeds made by notaries as authentic deeds and the actions of heirs who attempted to thwart their implementation. The results of the study show that these actions constitute tort because they cause losses to other heirs and hinder the process of legal inheritance distribution. In addition, this study identifies various legal remedies that can be pursued by the aggrieved party, both through litigation such as lawsuits and cassation, as well as non-litigation such as mediation and mutual agreement, in order to obtain justice and legal certainty in the distribution of shares as inheritance objects.
