Abstract
In this study, the author examines the issue of trademark dilution, focusing on the legality of using registered trademark to sell a different class of commodity without the trademark owner's permission and the impact of the legal vacuum in regulating trademark dilution in Indonesian trademark protection regulations on trademark owners' rights. This study utilizes a normative juridical legal research method, employing a statutory regulatory approach, a conceptual approach, and a comparative approach. The regulatory approaches used for the approach and research are laws and regulations concerning trademark and other regulations relevant to the topic under study. The conceptual approach in this study utilizes the concept of trademark dilution. The comparative approach is conducted by comparing Indonesian and United States trademark protection regulations. The research and analysis found that the legality of using the Baygon and Wipol brands to sell beverage bottles without the trademark owner's permission, as viewed from Indonesian brand protection regulations, is legal and does not violate regulations because these regulations do not prohibit the use of registered trademark without the trademark owner's permission to sell a different class of commodity from the commodity sold by the original trademark owner. Furthermore, the impact of the legal vacuum in the regulation of trademark dilution for the Baygon and Wipol brands, which are used to sell different classes of commodities without permission, is that the owners of these two trademarks cannot claim compensation or demand the termination of the use of these trademarks. keyword: Trademark Dilution, Trademark, Intellectual Property Right
