Abstract
Evidence in civil procedure law has varying degrees of weight. In general, letters have the highest evidentiary value, but this study will further discuss the weight of documentary evidence, particularly death certificates issued by village officials (village heads). In addition, this study also discusses the absolute authority to cancel death certificates. This is analyzed further to determine which court has the legal authority to handle such cases, given that death certificates are issued by the civil registry office. The purpose of this study is to educate the public and provide a reference for law enforcement officials who are still uncertain about the validity of death certificates issued by village heads and the absolute authority to cancel such certificates. The methods used to collect data were interviews at the Lamongan District Court and other references from laws, books, and legal journals. This study produced two main answers. The first is that, based on Supreme Court Jurisprudence Number 3901K/Pdt/1985, a death certificate issued by a village head has no legal force if the village head cannot be present for examination at the trial. The second finding is that the case of death certificate annulment based on the results of interviews and analysis of Law No. 5 of 1986 concerning Administrative Law is the absolute authority of the District Court.
