Abstract

This study discusses law enforcement against civil servants who commit the crime of gratification, focusing on existing laws in Indonesia and the obstacles faced in the law enforcement process. Civil servants often commit gratification because they feel inadequate about what they have received and are influenced by their environment. Based on Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning the Eradication of Corruption, this study uses an empirical juridical method with a statutory and case study approach, utilizing primary data through interviews with prosecutors at the Surabaya City High Court and prosecutors at the Surabaya City High Prosecutor's Office. The results indicate that the main obstacle in law enforcement against civil servants who commit gratification occurs in the process of proving the elements of Article 12 letter a concerning gratification. This study recommends improvements in the more effective handling of gratuities. This study is expected to serve as a reference in developing more effective policies and legal systems for handling gratuity cases committed by civil servants.
